Article 1 - Object of the contract
Company ING TELECOM markets a service of telecommunications (hereafter Service). The Service makes it possible to emit calls local, regionaux, national, international and towards mobiles starting from telephones branches on a France Telecom line. The presentes general conditions definissent the conditions of inscription, of use and of payment of this Service by the person or entity subscribing to it, hereafter the Subscriber names.

Article 2 - Obligations of ING TELECOM
ING TELECOM begins to implement the whole of the means at its disposal to offer to the Subscriber the best quality of possible service. ING TELECOM would not know, however, being held for person in charge for the failures of the Service, having involves or not a damage for the Subscriber, and
which would be the fact of a etrangere cause such as the fortuitous occurence, the fact of a third, the fact or the fault of the Subscriber, just as any damage who would be the consequence of an interruption in the electric supply of power, of the service of the local telephone operator, or other which are necessary to the operation of the Service. ING TELECOM will confirm to the customer his inscription by electronic mail or postal if the customer possede not of address e-mail.

Article 3 - Obligations of the Subscriber
the Subscriber engages with: - to transmit during the signature of the contract its coordonnees exact, in particular its number of telephone allots by the local telephone operator. The declaration of false information, number of telephone errone, bad address, etc, will involve the responsibility for the Subscriber,
- to pay the price of the services provided by ING TELECOM to the tariffs in force over the period of invoicing; these tariffs are available by telephone to customer service of ING TELECOM or on the Web site of ING TELECOM,
- to respect the technical preconisations of ING TELECOM with regard to the necessite to have throughout all contract, a telephone subscription subscribes aupres of the local telephone operator or not according to the type of provided Service,
- to prevenir ING TELECOM of any change concerning this local telephone subscription, in particular in the event of change of number or resiliation of line and to inform ING TELECOM of its new situation,
- to inform without delay ING TELECOM of any change of banking address or coordonnees
- not to resell or use it calls. The Subscriber will not be able ceder the presente inscription which is personal as an individual to him or representant of a legal entity, company or association.

Article 4 - Invoicing and payment of the Service
4.1 the tariffs of the Service, applicable to the date of subscription, are joined to the form of inscription. The tariffs are express in € (EURO) including
all taxes, rate of VAT of 19,6 %.

4.2 Telephone tariffs: The invoicing is carried out at the second as of the premiere second. The cost of the communications is rounded with the cent of euro superior. A regularization of the effect of rounded for the premieres minutes of communication will be effectuee monthly on request of the Subscriber and will appear on the invoices. ING TELECOM reserve the possibility of modifying constantly its telephone tariffs.

4.4 Payment: invoices ING TELECOM are payable monthly by automatic taking away on the bank account or postal of the Subscriber. ING TELECOM reserve right to carry out intermediaires taking away if in the course of month the consumption of the customer came to depasser a reasonable, fixed amount to 50 € including all taxes for a customer registered since less than one month and 300 € including all taxes for the others. In the event of delay of payment or rejection of taking away, ING TELECOM is authorized to suspend the line in the 2 days open according to the impaye and to invoice with the customer the bank charges and techniques induced which are assembled as an indication to 22 € including all taxes.

Article 5 - Disputes - Reclamations
Only the disputes or reclamations sended by postal or electronic mail with the customer service whose coordonates are precisees at the end of these general conditions will be taken into account by ING TELECOM.

Article 6 - Suspension of services
6.1 In the event of nonpayment total or partial of an invoice the Service could be suspended by ING TELECOM after warning written by electronic mail or postal.
6.2 ING TELECOM reserve the possibility of suspending the Service in the event of abnormal increase in the amount of the communications of the
Subscriber. The Subscriber will be prealablement formless.

Article 7 - Resiliation of services
7.1 the contract is subscribed for one indeterminee duration starting from its date of signature.

7.2 The Subscriber can resilier constantly his contract with ING TELECOM while addressing to ING TELECOM a mail recommends with shows
reception with the address indiquee at the end of these conditions. There are no expenses of resiliation.

7.3 ING TELECOM reserve the possibility of resilier constantly full Service for the following causes:
- not respect of the conditions generales/particulieres of the contract,
- false(s) declaration of the Subscriber relativ(s) to the contract,
- incident of payment of the Subscriber,
- withdrawal of the administrative authorisations necessary to the supply of the services,
- in the event of cause beyond control.
In the event of resiliation of the Service by ING TELECOM for one of these reasons, the Subscriber will be able to pretend with no damage and interêts.

7.4 The resiliation will be effective under 30 days open with reception mail recommends. The Subscriber will be informed by electronic mail to the closing date to the service. The Subscriber remains indebted sums due until this date.

Article 8 - Modifications
Without damage of the right of the Subscriber to resilier Service, ING TELECOM reserve capital duty constantly modifications to the presentes conditions with the help of the respect of a 15 days notice, like them reactualiser regularly in order to to take into account any obligatory of origin legale or jurisprudential evolution. ING TELECOM will inform the Subscriber by electronic mail or postal of the modifications apportees to the
presentes. With defect of resiliation under the conditions prevues by the article precedent, the Subscriber will be repute to have accepts these modifications.

Article 9 - Personal data processing
Personal information which is demandees with the Subscriber is covered by the law of January 6, 1978, relating to data processing and freedoms. The Subscriber lays out in consequence to the individual right of access and correction which this law recognizes to him.

Article 10 - Cessibilite of inscription
ING TELECOM reserve the faculte of ceder, transferer or to bring to a third, in some form that it is, the rights and obligations nes present contract.

Article 11 - Court of competent jurisdiction
The relations between ING TELECOM and the Subscriber are regies by the French law. The rules legales of attribution of competence will apply. With defect the court of VALVES will be only qualified to know possible litigations.

The Subscriber declares:
- to be formless that preselection ING TELECOM technically cancels any former preselection on the lines objects of the contract; and that the commercial cancellation of possible fixed prices and contracts subscribed before aupres of other operators falls on to him
- to be formless that in the event of modification of line affecting the number of line aupres of France Telecom, France Telecom does not renew the preselection automatically. In this case, the Subscriber will be able to carry out a new request for implementation of preselection by contacting ING TELECOM
- to have well note that if it wishes to put an end to the preselection one or more lines objects of the contract, it will have to make of it the request in writing with ING TELECOM. For any additional information, or in the event of difficulty before or after the implementation of the Service, the Subscriber can contact ING TELECOM:
